These Terms of Service ("Terms") govern your access to and use of ImgPrompts at https://imgprompts.net (the "Website" or "Service"). By accessing or using the Service, you agree to these Terms.

1. Service Scope

ImgPrompts currently provides a web-based AI image prompt, image generation, and image editing workspace.

The current production scope includes image workflows such as prompt drafting, text-to-image, image-to-image, restyling, and enhancement. These Terms do not promise standalone mobile app functionality.

For clarity, these Terms do not include commitments for music generation features.

2. Eligibility and Accounts

  • You must have legal capacity to enter into a binding agreement in your jurisdiction.
  • You are responsible for account credentials and activities under your account.
  • You must provide accurate registration and billing information and keep it updated.
  • We may suspend or restrict access if we detect unauthorized use, abuse, fraud, or security risk.

3. Payments, Plans, and Credits

  • Some features require paid plans, subscriptions, or credits.
  • Prices, included credits, billing cycles, and plan details are shown on the pricing/checkout pages.
  • Payments are processed by third-party payment providers. Your payment relationship with those providers may also be subject to their terms.
  • Unless required by law or explicitly stated otherwise, paid fees are non-refundable.
  • For subscription plans, cancellation takes effect according to the billing rules shown at checkout and in your billing settings.

4. Acceptable Use and Prohibited Conduct

You agree not to:

  • Use the Service for illegal, fraudulent, harmful, abusive, or deceptive activities
  • Infringe intellectual property, privacy, portrait, publicity, or other third-party rights
  • Upload or generate content involving exploitation of minors, non-consensual sexual content, extreme violence, or other prohibited material
  • Reverse engineer, disrupt, overload, probe, or interfere with the Service or related systems
  • Use automated methods to scrape or access the Service beyond reasonable and authorized use

You are solely responsible for content you submit and for ensuring you have all required rights and permissions.

5. User Content and License

  • You retain ownership of your input content and generated output to the extent permitted by applicable law.
  • You grant ImgPrompts a limited, non-exclusive, worldwide license to host, process, store, reproduce, and display your content only as needed to operate, secure, maintain, and improve the Service.
  • If you choose to publish content publicly through Service features, you grant us the rights necessary to display and distribute that content within the Service.

6. AI Output Notice

  • AI-generated output may be similar to content generated for other users.
  • You are responsible for reviewing outputs before commercial or sensitive use.
  • We do not guarantee that outputs are error-free, non-infringing, or fit for a particular purpose.

7. Intellectual Property

All rights in the Website, software, branding, and Service materials (excluding your content) belong to ImgPrompts or its licensors. These Terms do not transfer ownership of our intellectual property to you.

8. Service Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time, including features, model availability, pricing, or limits. We may also update these Terms from time to time.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access where reasonably necessary, including for violations of these Terms, legal obligations, or security concerns.

Sections that by nature should survive termination (for example, payment obligations, licenses granted, disclaimers, and limitations of liability) will survive.

10. Disclaimer and Limitation of Liability

The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by law.

To the maximum extent permitted by law, ImgPrompts is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, goodwill, or business opportunities arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless ImgPrompts and its affiliates, officers, employees, and agents from claims, liabilities, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.
